    Owner of Louisiana refinery faces record $12M fine (AP)

    NEW ORLEANS ? A Texas company that owns a refinery in southwestern Louisiana pleaded guilty Wednesday to felony violations of the federal Clean Air Act and obstructing justice and agreed to pay a record fine.

    Pelican Refining LLC will pay $12 million for problems at its Lake Charles refinery, including $2 million for air pollution monitoring and other environmental projects in the state, according to a plea agreement reached in federal court. A judge must approve the agreement.

    The Justice Department said the criminal fines would be the largest ever in Louisiana for violations of the Clean Air Act

    It also said Houston-based Pelican acknowledged that it had violated numerous standards in its permit ? including emissions of potentially deadly hydrogen sulfide ? and submitted false emissions reports to the Louisiana Department of Environmental Quality.

    Byron Hamilton, the Pelican vice president who oversaw operations at the refinery since 2005 from an office in Houston, pleaded guilty on July 6 to two Clean Air Act violations. He faces up to a year in prison and a $200,000 fine for each count, according to authorities.

    "We regret this chapter in our history" but Pelican and its employees have worked diligently since 2007 to make sure the refinery meets state and federal laws, company spokeswoman Dorothy Beeler said.

    Federal authorities said they opened an investigation after state inspectors in 2006 discovered illegal releases of hydrogen sulfide, improperly repaired or bypassed pollution monitoring and control equipment and oil stored in unrepaired tanks.

    The refinery also had no company budget, no environmental department and no environmental manager, according to Pelican's court admission. The flare used by the refinery to burn off emissions ? including hydrogen sulfide ? was not properly functioning and employees typically took turns trying to relight it with a flare gun, the government said.

    Also as part of the plea agreement, Pelican would be banned from operating a refinery until it implements an environmental compliance plan, including external auditing by independent firms and oversight by a court-appointed monitor.

    Dow flirts with break-even for '11, stocks end up

    The Dow industrial average flirted with its break-even mark for 2011 on Wednesday as part of a rally that had the major indexes end trading with gains.

    According to preliminary calculations, the Dow Jones industrial average finished up 102.55. or 0.90 percent. to 11,518.85. On Jan. 3, the first trading day of the year, the index closed at 11.674.76. Around 2:30 p.m. ET, it reached an intraday high of 11,601.31 before faltering.

    The index had been up for the year until a massive slide in late July.

    The S&P rose 11.71, or 0.98 percent, to 1,207.25. The Nasdaq ended 21.70 higher, or 0.84 percent, to 2,604.73.

    Slovakia, suddenly seemingly Wall Street?s biggest power broker, helped stocks sustain their healthy gains.

    The tiny Eurozone member, voted yesterday to reject a plan to shore up Europe?s banks and address the Union?s debt crisis. Though the vote happened after markets close, the major indexes were flat ahead of the move.

    The government there fell, and the new one approved the measures today.

    The New York Times? take on Europe and the market:

    Analysts said that recent turmoil in the markets had effectively forced European leaders to show real progress in confronting problems related to sovereign debt.

    ?The market has screamed loud enough to make the European authorities stand up and listen,? said Andrew Wilkinson, chief economic strategist for Miller Tabak & Company.

    Investors have been?focused almost exclusively on the European debt crisis for weeks?amid concerns that if Europe does not resolve it quickly, it could?spark another recession.

    Aside from Europe, investors were be looking at quarterly corporate earnings. Companies began reporting their results?Tuesday. They are widely expected to report higher profits, although the banking sector may show it is beginning to struggle.

    Network that mistook game for terrorism investigated

    This above footage captured by the IRA in 1988 proves that ... wait, you say this isn't real, honest-to-goodness terrorism in action?

    A British media regulation organization has launched an investigation into a TV network that aired a documentary program that claimed to show footage of terrorists blowing up a helicopter?? but actually showed footage from a video game.

    The independent regulatory organization?? Ofcom?? announced Monday that it is investigating the UK TV network ITV for its program "Exposure: Gaddafi and the IRA," which aired Sept. 26.


    The program, which explored the connection between the IRA terrorist organization and Libya's Colonel Moammar Gadhafi, showed footage allegedly captured by the IRA in 1988 in which the militants use Gadhafi-supplied heavy machine guns to shoot down a helicopter.

    But gamers spotted that footage for what it was: A segment from the military shooting game "ArmA 2." ITV has since removed the program from its online site, though, of course, YouTubers have made sure we can continue to get a look at the flub here:

    According to British newspaper The Guardian, Ofcom announced Monday that it will be launching an investigation to see whether the incident?? which ITV chalked up to "human error"?? constitutes a breach of the Broadcasting Code. Ofcom regulates the?UK?TV and radio sectors as well as telecommunication and mobile industries.

    ITV has apologized and?said the events in the program?? which was to be the first in a new hard-hitting and investigative?series?? were real. However, during the editing process the producers accidentally used the game footage rather than the correct clip, ITV said.

    If that seems hard to believe, note that there is this fan-made YouTube clip that claims the game footage is real IRA footage and may have been the source of confusion. Though, even if it was a simple mistake, the question remains: Why were these investigative documentarians turning to YouTube for their footage?

    Needless to say, the denizens of YouTube have since had some fun at ITV's expense:

    In DR. DEAH'S HOLLYWOOD: There's No Place Like Home ...

    There's no place like homeI would ask you to close your eyes, but then you couldn?t keep reading and that would be awkward.?? So, imagine you are closing your eyes and think of a time when you felt completely in sync with your surroundings; comfortable in your skin from the inside, and at ease with where your skin just happened to be in that moment, on the outside.

    Maybe it?s one of those rare times getting out of the tub, a pool, lake, or tropical ocean where the air temperature was similar enough to the water temperature so there was no jolt when you got out of the water.

    Or waking up the morning after a presidential election and the candidate you voted for had won?and for a few hours your political belief system is one with an outside community of like minded folks.

    How about a concert you went to where you knew EVERY word to EVERY song and EVERY person sitting around you did too? You, the band on stage, and everyone around you were joined in a musical simultaneous orgasmic vocal explosion!? For those few moments there was no discord and all was right with the world. MMM?YUM.

    These bright moments are exhilarating; sometimes in calm, peaceful ways, other times joyful and energizing. Whatever form they take, these surprises in life, when we feel at home within and without, make living a WONDERFUL adventure.

    I had one of these moments when I went to see the film, America the Beautiful 2: The Thin Commandments.? It was a special screening sponsored by several eating disorders organizations:? La Ventana,? Ocenaire, Center for Discovery,? Reasons, and a fundraiser for The Eating Disorders Resource Center (EDRC).

    I entered the theater confident that I would be part of an audience that ?knew all of the words to the same songs that I knew.?? What I didn?t know was whether the film would strike the familiar chords and cover the play list the audience was hoping for.? After all, making a documentary about the extraordinarily complicated interrelationships among food, weight, health, eating disorders, and dieting, is no easy task.

    Meet our protagonist, Darryl Roberts, a man who loves food and hates exercise.? Darryl is visiting a doctor for the first time in ten years and is hit with a cyclone of bad news; his blood pressure is high and his heart has some irregularities.? The doctor, following medical protocols, prescribes two blood pressure medications and sends a deflated Darryl, on his way.? But the storm only worsens and he is hit upside the head with the news that the medications have (im)potential side effects.? ?Finding this a hard, so to speak, pill to swallow, it dawns on him that he isn?t in Kansas anymore. ?And so, we are invited to join our not so little ?Darryl Gayle,? as he sets off to find the Wizard of Weight Loss.? This wizard will be great and powerful, will grant his wish to be healthy and bestow upon him a more uplifting way to avoid the stroke that is surely lurking around the next bend.

    Darryl?s? journey has all of the required elements of a classic odyssey; a trip tik of funny, tragic, and outrageous run-ins with good and evil witches, fierce flying monkeys, and fellow truth seekers?aka a realistic sampling of well-meaning but sometimes insidious members of the diet, medical, eating disorders, nutritional, and fitness industries.? And because it is Hollywood, Hollywood, (with more connections than Dr. Deah?s Hollywood), there are some riveting cameos including:? Deepak Chopra, Secretary of Health, Kathleen Sebelius, and the Arch Bishop of New York, Timothy Dolan. (Unfortunately there is no Dr. Oz, although the irony of that would NOT have escaped me!) This passionate star studded supporting cast speaks their truths about weight loss, health, and diets and add to the intrigue of Mr. Roberts? quest.

    But perhaps what makes this film so successful is the accessible like-ability of Darryl Roberts.? He is a down to earth?man we cannot help but identify with; as he attempts to stick to a 28 day regime of organic raw food and colon cleansing during which time we find out that his heart is NOT the only part of Darryl?s world that is irregular?if you catch my drift.

    We are in the kitchen with him as he eats his ?last hurrah? meal before the diet.? Standing up, as binge eaters frequently do, we are co-relishing in what is certainly, in that moment, his last piece of chocolate cake, EVER.? We are walking side by side with him as he finally snaps from one too many tofu kebabs and dives into the comfort and greasy satisfying?joy and ?joyness? of fried chicken.

    I do not think I was the only one champing at the bit to run to his defense when a diet doctor shows disdain for fat people by admonishing them for staying fat because they are too lazy to stay on a diet. Dr. Shapiro opines and challenges Darryl to dispute the fact that deep down inside everyone, if honest, wants to be thin.

    As his quest continues, he establishes our solidarity with survivors of weight loss surgeries and eating disorders, taps into our empathy for the obsessive exerciser who would rather workout than have a relationship. (She is emphatic that her happiness would inevitably lead to weight gain). ?He opens our hearts to the boys who are members of an eating disorders group and a woman struggling with anorexia.

    As the movie progresses, he ignites our anger by deftly connecting the dots and illustrating that the reinforcement we give and get for losing weight and working out can backfire; and what begins as a spark of disordered eating billows into the raging fire of a fully fledged eating disorder.

    Roberts recruits our activism when his questions about government subsidies for corn and the possible connection to obesity were not responded to by Kathleen Sebelius, Director of Health and Human Services who ends the interview by remarking that she doesn?t know about eating disorders or the diet industry.

    As he explores the over inflated importance that the National Institute of Health places on BMI as an indicator of health, he jump-starts our outrage at the questionable connection between certain high profile health professionals and the Weight Watchers? advisory board.

    He garners our admiration for Ragen Chastain,? a 250+ pound dancer, and other people who are living happy healthy lives but have to battle stigmatization and dispel the myths about fat and health on a daily basis.

    And finally, he conducts the audience in a chorus of sighs of relief after listening to psychiatrists and other health professionals:? Dr. Norman, Jon Robison,? Paul Campos,? Judith Matz, Linda Bacon,? and Evelyn Tribole,? ( a partial list click here for the full cast) explain that according to longitudinal studies, restrictive diets lead to weight cycling NOT long term weight loss nor are they the answer to lowering high blood pressure. ?Instead we are offered a saner, alternative that is health focused instead of weight focused.? The Health at Every Size? approach proposes that a balance of fun physical activity, in Darryl?s case bicycling, combined with mindful-eating, results in stabilized health markers and removes the deleterious co-morbid conditions associated with weight fluctuations.

    But that is my clinical jargon seeping out and I am wearing my Dr. Deah?s Hollywood Film-stanista hat? and as I watched the film I was purring with contentment. There I was immersed in one of those bright moments when my beliefs and surroundings were congruent.? Still purring, I left the theater feeling curious about how the mainstream audience will react as many will be exposed, perhaps for the first time, to a comparison between the two self-help roads to? self-health ideologies, Health at Every Size? and Dieting. They will watch a well crafted documentary filled with glimpses into some funny, some ludicrous and other truly painful experiences that living in a culture obsessed with thinness has inflicted upon many of us.? They will witness how the desire to live healthy lives often paradoxically results in adopting unhealthy behaviors and attitudes.? And with all of that being said, I predict (and hope) they will breathe a sigh of relief; and experience their own bright moment when they learn there is another way. We all have a choice that doesn?t require going somewhere else and breaking the bank in order to attain self acceptance and a healthy way of life.? Close your eyes and think about that!? MMM?YUM.

    US military targets post-Afghan missions

    The American military reinvented itself to fight insurgencies during the decade of combat that began with an onslaught against the Taliban 10 years ago Friday.

    Having focused so narrowly ? and spent so heavily ? on fighting insurgents and terrorists rather traditional armies, navies and air forces, U.S. military leaders are eager to turn to a wider range of threats, including potential conflict with China. They will have less money at hand, but they do possess a battle-seasoned force dominated by soldiers who have never served in peacetime and commanders who learned the hard way that the next battle never looks the same as the last one.

    In both Iraq and Afghanistan, the military has operated virtually unchallenged in the air. Nor has it faced large-scale missile attacks or cyberthreats. Instead it was challenged by improvised roadside bombs, kidnappings and propaganda assaults. Looking ahead, strategists see a different set of threats, particularly from a Chinese military that is modernizing air and naval forces and posing a potential menace to U.S. dominance in space.

    As an illustration of how long the military has been continuously at war, the F-14 Tomcat fighters that helped launch the American-led invasion four weeks after the Sept. 11, 2001, terrorist attacks have been retired for the past five years. And the aircraft carrier from which they flew, the USS Enterprise, is to be retired in 2013, one year before U.S. and NATO troops are to hand the war's lead role to Afghan forces.

    A pivot to the threats of the future will require reorienting the way the military trains and plans, and maybe how and what it buys.

    Complicating this effort, to an extent not foreseen even six months ago, is the likelihood of big reductions in the defense budget.

    It now seems certain that the military will shrink, and so, too, may the ambitions of the national defense strategy it will be expected to execute.

    Easing strains
    The war in Afghanistan, combined with even more intense years of combat in Iraq, put strains on the U.S. military that will ease only gradually. As they do, the push to cut defense spending is likely to generate super-heated competition among the four major services. The smallest, the Marines, already are campaigning to recalibrate their role as a seafaring "expeditionary" force, and the Air Force and Navy are collaborating on a new doctrine, known as "Air Sea Battle," to define how they intend to operate together more effectively in the Asia-Pacific region.

    The Army is eagerly awaiting a postwar respite from the rigors of repeated deployments for ground troops. But the largest service is feeling pressure to adapt. For most of the past decade it has focused mainly on countering insurgencies in Iraq and Afghanistan. The pace was so fast that Army leaders had little time to think beyond those battles, and soldiers enjoyed little time between combat tours.

    "We're a tired Army," Gen. Richard Cody, a retired former Army vice chief of staff, told a House committee on Tuesday. American ground forces ? both the Army and the Marine Corps ? are "worn thin," he said, and should be spared sharp budget cuts.

    Lt. Gen. Mark Hertling, the Army's top commander in Europe, put it this way: "We are an Army whose systems need to be polished. They've rusted." By that he meant, for example, that the Army needs to improve how it manages training and disciplines soldiers. While misbehavior is not widespread, he said, it has become a problem that demands fixing. Left long unattended, he said, it could become "cancerous."

    War takes toll
    The Afghanistan war has taken a toll on the Army in other, narrower, ways. Gen. David McKiernan, who made his mark as a commander in the early years of the Iraq war, was sacked as the top commander in Afghanistan in 2009 with the war going badly. Barely a year later his successor, Gen. Stanley McChrystal, who was widely seen as one of the Army's brightest stars, was forced out in a flap over comments in a magazine article.

    The U.S. now has about 98,000 troops in Afghanistan. Under a plan announced by President Barack Obama in July, 10,000 will come home by the end of this year and 23,000 more by September 2012. Gradually, they intend to hand over security duties to the Afghans, who, despite a decade of training by U.S. and NATO troops, still lack much of the capability and expertise needed to prevent a return to power by the Taliban.

    For several years, during the worst period of the Iraq war, the fighting in Afghanistan seemed secondary and casualties gained relatively little attention in the U.S. But in 2009 that began to change, as reflected by the fact that two-thirds of the almost 1,700 U.S. deaths in Afghanistan have happened since then.

    The U.S. military will not leave Afghanistan abruptly, if current plans hold. Marine Gen. John Allen, the top U.S. and NATO commander in Kabul, said recently that although the Afghans will take the lead for security by the end of 2014, "We're going to be here a long time." The Obama administration has vowed not to abandon the Afghans, as the U.S. did after it helped anti-communist guerrillas oust Soviet forces in 1989.

    Even so, attention is turning to postwar priorities.

    Navy Adm. Mike Mullen, in his farewell remarks as chairman of the Joint Chiefs of Staff on Sept. 30, said the urgency of fighting in Iraq and Afghanistan left some worrisome soft spots in the military.

    "We have become the best counterinsurgency force in the world, but we have done so at the expense of critical conventional capabilities we necessarily let lapse," he said.

    "We have become the most expeditionary force in our history but in the process sacrificed some of the basics of garrison leadership and continuity that preserve the health of our all-volunteer force."
